seen together at a dinner in washington on october 27th. officials say the cia has been told by the fbi there is no indication that petraeus used classified material. but the investigation is continuing, this is new information coming out about frederick humphries, the fbi agent that led the investigation. that led to petraeus's resignation. he is a 16-year veteran, he played a major role in stopping the plot to blow up l.a.x. humphries got to know jill kelley in tampa, and she turned to him when she received anonymous e-mails last spring, the e-mails they found alarming. today, the fbi agent explained the shirtless picture he had sent jill kelley, saying it was a joke he was posing with target dummies after s.w.a.t. practice. it was humphries that told david reichert about an old friend, he alerted him almost two weeks before the president was told. >> the information sent to me sounded as if there was a potential for a national security vulnerability. >> reporter: today, eric holder was asked why he didn't tell the president sooner. >> we follow the facts, we do not share outside the

can tell, is the conditions which the fbi came to read the private e-mails of petraeus and broadwell. the investigation began because jill kelley, an acquaintance of petraeus served as the unpaid liaison in tampa received hostile e-mails that chastised her for flirting with petraeus. kelley complained to an fbi agent and somehow, an fbi investigation into cyber stalking was opened, one that led the fbi to read broadwell's e-mails, then petraeus' and here we are. cyber stalking investigations appear to be rare. thousands of women are cyber stalked every year. the recourse for them is often nothing, which is a problem. ten cases have been prosecuted. somehow in this case, because jill kelly knew a guy, an investigation got opened here. if the thing that decides whether a case is open is someone has an agent's business card, then we are in trouble. in the midst of this coverage, it's difficult to separate it from trivial and the relevant. as gripping as the tale is, it is almost entirely that, a human drama. people acting as people do. i'm reasonably sure, a sweep of e-mails opened at r

correspondent john miller, former fbi national intelligence official, joins us with the latest on the fbi and the president of justice investigations. good morning. >> good morning, charlie. we spoke a friend of the broadwell family who told us they were overwhelmed by the outpouring of support from neighbors. 25 of them came over with all kinds of food and kind of set up camp there. on the home front it looks like things are coming back together. on the legal front there's a little more concern. let's go through the mechanics here. when this starts out, the agents get the stalking complaint and instead of waiting to get through the case and then bring it to a prosecutor, right at the beginning, because they see who this might involve, they go to an assistant u.s. attorney and say, if we go through with this, is there a prosecution your office would go forward with? and that tampa office says yes. then the special agent in charge of the tampa office reviews the case. he says this involves some big names. some interesting possibilities. let's kick this up a level. he brings it to robert o'
